Terms and Conditions
All rights are reserve to DeeDoc Consulting Group. During the term of this agreement,
the customer must conform to the Terms and Conditions and the Acceptable Use Policy
of Jajasa.com, a subsidiary of Deedoc Consulting. We reserve the right to modify
without prior notice. All modification to the terms becomes effective 24 HRS after
posting on TruQuat.com Website.
Responsibility:
- You will be responsible for your sites and content. All sites that you host should
be in accordance with all rules (AUP, Privacy Policy) and regulations of Jajasa.com.
Misuse by you may result in actions on your account, including removal from the
host with/without a notice and without a refund.
- Jajasa.com makes no warranties of any kind, expressed or implied for services we
provide. Jajasa.com will not be responsible for any damages your business may suffer.
Jajasa.com disclaims any warranty or merchantability or fitness for a particular
purpose. This includes loss of data resulting from delays, non-deliveries, wrong
delivery, and any and all service interruptions caused by Jajasa.com, its employees,
suppliers, customers or any third party.
Account Setup:
- We will setup your account after we have received payment. It is your responsibility
to provide us with an email address which is not @ the domain(s) you are signing
up under. All orders are verified before activation to get rid of orders made with
the intention of 419 or scams. We do not issue refunds on such orders. Providing
false contact information of any kind may result in the termination of your account.
Acceptable Use Policy:
- You must be in full compliance of the Jajasa.com Acceptable Use Policy. Please familiarize
your business with Jajasa.com AUP.
Bandwidth Usage:
- You are allocated a monthly bandwidth allowance. This allowance varies depending
on the hosting package you purchase. Should your account pass the allocated threshold
limit we reserve the right to suspend the account until the start of the next allocation,
suspend the account until more bandwidth is purchased at an additional fee, suspend
the account until you upgrade to a higher level of package, terminate the account
and/or charge you an additional fee for the overages.
Billing & payments:
- You have agreed to supply appropriate payment for the services received from Jajasa.com,
in advance of the time period during which such services are provided. You agree
that until and unless you notify Jajasa.com of your desire to cancel any or all
services received, those services will be billed on a recurring basis.
- Cancellations must be done in writing via the cancellation form provided. Once we
receive your cancellation and have confirmed all necessary information with you
via e-mail, we will inform you in writing via email that your account has been canceled.
Your cancellation confirmation will contain a ticket/tracking number in the subject
for your reference, and for verification purposes. You should immediately receive
an automatic "Your request has been received" email with a tracking number. Jajasa.com
will confirm your request and process your cancellation. If you do not hear back
from us, or do not receive the automatic confirmation email within a few minutes
after submitting your cancellation, please contact us immediately via Chat, Email
or phone. We require that cancellations of service are done through the online form
to (a) confirm your identity, (b) confirm in writing you are prepared for all files/emails
to be removed, and (c) document the request. This process reduces the likelihood
of mistakes, fraudulent/malicious requests, and ensures you are aware that the files,
emails, and account may be removed immediately after a cancellation request is processed.
- As a client of Jajasa.com, it is your responsibility to ensure that your payment
information is up to date, and that all invoices are paid on time. Jajasa.com provides
a 10 day grace period from the time the invoice is due and when it must be paid.
Any invoice that is overdue for 10 days and not paid will result in a late fee and/or
an account suspension until account balance has been paid in full.
- Jajasa.com reserves the right to change the subscription amount and any other charges
at anytime. Contracted customers shall not be affected by changes before their due
dates.
Chargeback and Payment Disputes:
- All payment disputes must be raised via the support ticket system.
- If you dispute a payment through your credit card company, through PayPal or another
financial institution we may immediately suspend or terminate all services you have
purchased from us pending resolution. If we are charged a chargeback settlement
fee, or other fee related to the payment dispute, we may pass this fee onto you.
Cancellations and Refunds:
- Jajasa.com reserves the right to cancel any account at any time with or without
notice.
- Customers may cancel at any time via a cancellation form.
- The following methods of payments are non-refundable, and refunds will be posted
as credit to the hosting account:
- oBank Wire Transfers
- o InterSwitch Debit Cards
- o Cheque's
No Refunds:
- There are no refunds on dedicated servers, administrative fees, install fees for
custom software, or domain name purchases.
- Only first-time accounts are eligible for a refund. For example, if you've had an
account with us before, canceled and signed up again, you will not be eligible for
a refund or if you have opened a second account with us.
- If you violate our terms and conditions we may terminate or suspend (temporarily
or indefinitely) any services you have with us. In this case no refund will be given
for any payments that have been, or are made by you to us.
- Following a violations of or terms and conditions, we may levy an investigation
charge of 20.00 per instance.
Backups and Data Loss:
- Jajasa.com is not responsible for files and/or data residing on your account. You
agree to take full responsibility for files and data transferred and to maintain
all appropriate backup of files and data stored on Jajasa.com servers.
Transfers:
- Transfers are provided as a courtesy service to our customers, and we can not make
guarantee the availability, possibility, or time required to complete an account
transfer.
Server Maintenance:
- We might have, from time to time, perform maintenance, upgrades or replacements
to our servers. We reserve the right to suspend access to such server during the
required time to do the maintenance, upgrade or exchange the server, for no more
than 8 hours. In this event, the users will be sent an e- mail at least 24 hours
before the due date and time for maintenance
Indemnification:
Customer agrees that it shall defend, indemnify, save and hold Jajasa.com harmless
from any and all demands, liabilities, losses, costs and claims, including reasonable
attorney's fees asserted against Jajasa.com, its agents, its customers, officers
and employees, that may arise or result from any service provided or performed or
agreed to be performed or any product sold by customer, its agents, employees or
assigns. Customer agrees to defend, indemnify and hold harmless Jajasa.com against
liabilities arising out of; (1) any injury to person or property caused by any products
sold or otherwise distributed in connection with Jajasa.com; (2) any material supplied
by customer infringing or allegedly infringing on the proprietary rights of a third
party; (3) copyright infringement and (4) any defective products sold to customers
from Jajasa.com server
Termination and Suspension
- You may terminate your hosting at any time by advising us via a support ticket that
you wish to do so.
- We may suspend any or all of your services where we have reason to suspect a violation
of our terms and conditions whilst we investigate the suspected violation. We may
suspend your services where we have reason to suspect that a script installed on
your site is being abused while we investigate the suspected abuse.
- We may modify any of these terms and conditions contained, at any time and in our
sole discretion, by posting a change notice or a new agreement on our site. Your
continued participation now, or within thirty (30) days following the posting notice
of any changes in these terms and conditions, will constitute a binding acceptance
by you of such rules, changes or modifications. If any modification is unacceptable
to you, your only recourse is to terminate your account(s). In this case, a pro-rata
repayment of web hosting costs will be made.
